Terms of Service
Effective date: July 3, 2026
These Terms of Service ("Terms") govern your use of submitpak.com and the SubmitPak application (together, the "Service"), operated by SubmitPak LLC, a Georgia limited liability company ("SubmitPak," "we," "us"). By creating an account or otherwise using the Service, you agree to these Terms.
1. The Service
SubmitPak assembles flooring product submittal packages — a cover sheet, sustainability summary, and your supporting product documents matched to the exact SKU and revision — from the product selections and documents you provide. SubmitPak is currently in early access: features, availability, and pricing are still being finalized, and we may change or discontinue parts of the Service as it develops.
2. Accounts
You need an account to use the application. You're responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for activity that happens under your account. Tell us right away at josh@submitpak.com if you suspect unauthorized use.
3. Your content
You retain ownership of the documents and data you upload ("Your Content"). By uploading Your Content, you grant SubmitPak a limited license to store, process, and reproduce it solely to provide the Service to you — to build the submittal packages you request. We don't sell Your Content, use it to train third-party AI models beyond the API terms described in our Privacy Policy, or share it with anyone except as described there. You're responsible for having the right to upload the documents you upload.
4. Acceptable use
Don't use the Service to upload content you don't have the right to use, to attempt to access other users' accounts or data, to interfere with the Service's operation, or to violate applicable law.
5. Pricing and payment
SubmitPak is in early access and does not yet process payments. Pricing shown on submitpak.com/pricing reflects our current opening estimates and is being finalized — it is not a locked commitment, and we'll communicate before any billing begins. When paid plans launch, these Terms will be updated to include the applicable payment terms.
6. Intellectual property
SubmitPak, our logo, and the software and design of the Service are owned by SubmitPak LLC. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service as intended.
7. Disclaimers
The Service is provided "as is." SubmitPak assembles the package completely and with current, matched documents to the best of the information available to it — but we do not and cannot guarantee that any submittal package will be approved by a reviewing architect, engineer, or general contractor. That decision belongs to the reviewer, not us.
8. Limitation of liability
To the fullest extent permitted by law, SubmitPak and its officers, employees, and agents are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose (or $100 if you haven't paid us anything, since the Service is currently free during early access).
9. Termination
You can stop using the Service and close your account at any time by emailing josh@submitpak.com. We may suspend or terminate access to the Service for violation of these Terms or acceptable use.
10. Changes to these Terms
We may update these Terms as the Service develops, especially as billing launches. We'll update the effective date above when we do, and for material changes, make a reasonable effort to notify account holders.
11. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws principles.
